Regulatory Model
GetBotl operates as a technology marketplace under New York State law. Understanding our regulatory model is essential for consumers, retail partners, regulators, and law enforcement.
What GetBotl Is
- A licensed technology marketplace that connects verified adult consumers with NYSLA-licensed retail stores
- A provider of identity verification, payment processing, and logistics coordination services
- A platform that facilitates, but does not complete, the legal sale of alcohol
What GetBotl Is Not
- GetBotl does not hold an alcohol retail license (on-premises or off-premises)
- GetBotl does not take legal title to any alcohol products at any point in a transaction
- GetBotl does not warehouse, store, or physically handle alcohol products
Under this model, the following legal principles govern every transaction on the platform:
- ✓All alcohol is owned and sold by NYSLA-licensed retail partners. The legal sale occurs at the point of checkout between the consumer and the licensed retail store.
- ✓All alcohol is delivered by trained couriers in strict compliance with NY ABC Law delivery requirements, including mandatory in-person age verification at the door.
- ✓All alcohol is purchased exclusively by verified adults (21+) who have completed GetBotl's mandatory identity and age verification process.
- ✓All orders are accepted and fulfilled only during legally permitted sales hours in the applicable jurisdiction, as defined by NY ABC Law and borough-specific regulations.

New York State Compliance
GetBotl's operations are built around the requirements of New York State Alcoholic Beverage Control Law. Below are the key statutes governing our platform, with references to the underlying legislation.
NY ABC Law Section 63 — Off-Premises License Requirements
Section 63 governs the issuance and requirements of off-premises liquor licenses in New York State. All GetBotl Merchant Partners are required to hold a valid NYSLA off-premises license authorizing the retail sale of the specific categories of alcohol they carry. Licenses are verified against NYSLA public records before a merchant is onboarded and are monitored on an ongoing basis throughout the partnership.

NY ABC Law Section 65 — Prohibition on Sales to Minors
Section 65 makes it unlawful to sell, deliver, or give away alcoholic beverages to any person under 21 years of age. GetBotl's response to this requirement is a mandatory two-layer verification system: digital pre-verification at account creation and in-person courier ID check on every delivery. NY ABC Law Section 101-b — Hours of Sale
Section 101-b establishes permitted hours for alcohol sales in New York State, with variations by borough and license type. GetBotl enforces sales hour restrictions at the platform level — orders are only accepted during permitted hours for the borough where the retail partner is located. Attempting to place an order outside permitted hours will result in the order being declined at checkout.
NYC Administrative Code — Delivery Regulations
In addition to state law, GetBotl complies with applicable New York City Administrative Code provisions governing alcohol transport and delivery within the five boroughs. Our couriers are trained on NYC-specific delivery regulations and operate in compliance with applicable local requirements.
Section 3
Merchant Licensing Requirements
Every retail store that participates in the GetBotl marketplace must meet and maintain strict licensing requirements under New York State law.
- ✓Valid NYSLA Off-Premises License: Merchants must hold and maintain a valid NYSLA off-premises license appropriate for the categories of alcohol they sell. This includes Off-Premises Liquor Store License, Beer License, Wine Shop License, or applicable combination licenses as authorized by the NYSLA.
- ✓Active Status: The license must be in active, good-standing status. Licenses that are expired, suspended, revoked, or under formal enforcement action do not qualify for platform participation.
- ✓Displayed at Premises: The NYSLA license must be displayed at the merchant's licensed premises as required by law.
- ✓Renewal Compliance: Merchants are required to renew their NYSLA license before its expiration. GetBotl sends automated alerts 90 days prior to license expiration to help merchants maintain compliance.
- ✓Immediate Notification Obligation: Merchants must immediately notify GetBotl of any NYSLA investigation, enforcement action, license suspension, ownership change, or other event that may affect their license status or authority to sell alcohol.
- ✓Ongoing License Monitoring: GetBotl continuously monitors Merchant Partner license status against the public NYSLA license database. Discrepancies trigger immediate review and may result in platform suspension.

Any Merchant Partner found to be operating on the GetBotl platform with an expired, suspended, or revoked NYSLA license will be immediately and indefinitely suspended from the platform. GetBotl will report such violations to the NYSLA where required or appropriate.
Section 4
Courier Compliance
Couriers who fulfill deliveries through the GetBotl network are trained and held to rigorous compliance standards before and during their service on the platform.
Mandatory Compliance Training
All couriers must complete GetBotl's mandatory alcohol delivery compliance training before fulfilling their first delivery. This training covers:
- New York ABC Law requirements for alcohol delivery, including Section 65 (sales to minors) and Section 101-b (hours of sale)
- Age verification procedures: what IDs to accept, how to check date of birth, how to handle reluctant recipients
- Document identification: recognizing valid vs. expired vs. potentially forged identification
- Lawful refusal protocols: when and how to refuse a delivery and the legal obligation to do so
- Handling visibly intoxicated recipients: couriers are required to refuse delivery to any person who appears to be visibly intoxicated
- Return procedures: how to handle products when a delivery cannot be completed
Couriers do not take legal title to the alcohol products they deliver. They act as agents of the licensed retail partner at the moment of delivery. This means that at the point of delivery, couriers are operating under the authority of — and in compliance with the obligations of — the retail partner's NYSLA license.
- ✓Couriers have full authority and obligation to refuse any delivery where age verification cannot be completed
- ✓Courier refusal decisions are final and are backed by both NY ABC Law and GetBotl platform policy
- ✓Couriers cannot be overridden, pressured, or instructed to complete a delivery where valid ID cannot be confirmed
- ✓Couriers log all refused deliveries with timestamp, reason, and any relevant notes for compliance record-keeping

GetBotl's expansion into new markets is contingent on obtaining any required regulatory approvals, establishing compliant merchant partnerships, and ensuring our platform meets all applicable state and local requirements. We will not launch in a new market without full regulatory confidence.
